When employers in the Commonwealth are cited for alleged violations of Kentucky's Occupational Safety and Health Act and Standards, the Kentucky Occupational Safety and Health Review Commission provides an opportunity for the contesting party to come to a hearing and defend against the citations and penalties. According to KRS 338.071, the KOSH Review Commission is an independent agency. The commission is composed of three members who are appointed by executive order of the governor. Each member is appointed based upon a specific area of expertise: one member represents the interests of employers, one represents the interests of employees and one represents the occupational safety and health profession. The members must have a minimum of five years' experience in their respective areas of expertise. This diversity assures that the interests of all litigants appearing before the commission are represented and that due process of law is provided with an even hand. The Commission operates under KRS 338 and 803 KAR 50.
The Governor's Scholars Program originated in 1983. In 1994, the Program was transferred from the Governor’s Office to the Office of the Secretary of the Education, Arts and Humanities Cabinet. The Program is a summer residential program for outstanding high school students in Kentucky who are rising seniors. Selected students attend the Program without charge. The program is headed by an Executive Director appointed by the Secretary with approval of the Governor. The Program operates under KRS 158.796.
The Office of Vocational Rehabilitation is headed by an Executive Director and is the sole state agency charged with the purpose of developing and approving state plans required by state or federal laws and regulations as prerequisites to receiving federal funds for vocational rehabilitation. KRS 151B.185 organizes the Office into the following Divisions: Program Services and the Carl D. Perkins Vocational Training Center. The Office of Vocational Rehabilitation assists eligible individuals with disabilities achieve their employment goals.
The Department for the Blind was originally established as a business enterprise program for the blind by the Division of Vocational Rehabilitation in the Department of Education in 1948. In 1956, the State Rehabilitation Agency in the Department of Education took over this program. In 1958, a Division of the Blind was created in the State Rehabilitation Agency. These functions were placed in the Bureau for the Blind when it was created within the Education and Humanities Cabinet, in 1976. The Bureau was renamed the Department for the Blind in 1988 and in 1990 was transferred to the Cabinet for Workforce Development. By 2010, it was renamed the Office for the Blind within the Department for Workforce Investment. The Kentucky Office for the Blind is a state government rehabilitation agency that assists persons who are blind or visually impaired. The Office operates under KRS 163.450 through 163.480.
The Kentucky Environmental Education Council (EEC) was established in 1990 to improve Kentuckians’ understanding of their environment. EEC’s goal is to provide citizens with the knowledge they need to make their own informed decisions about their environment. EEC operates under KRS 157.900 through 157.915.

The Commission for the Deaf and Hard of Hearing was established in 1982 in accordance with KRS 163.500-163.520 as The Commission for the Deaf and Hearing Impaired. In 1994, it was renamed the Commission for the Deaf and Hard of Hearing. The Commission serves in an advisory capacity to the Governor and the General Assembly concerning policy and programs to enhance the quality and coordination of services for the deaf and hearing impaired in both the public and private sectors. Additionally, the Commission oversees the provision of interpreter services to the deaf and hearing impaired. The Commission also compiles needs assessment surveys and a census of the deaf and hearing impaired population.
This series documents the process taken by the Kentucky Occupational Safety and Health Review Commission (KOSHRC) when employers are cited by the Kentucky Labor Cabinet, Division of Occupational Safety and Health Compliance for alleged violations of Kentucky's Occupational Safety and Health Act and Standards, and/or an employer or employee contests the citations. Once an employer files a notice of contest, the case comes under the jurisdiction of KOSHRC which shall "afford an opportunity for a hearing," per KRS 338.141 (3). A hearing officer is assigned; and in the event the case is not settled, the hearing officer will then conduct a hearing on the merits. The Hearing Officer's Recommended Order may be appealed to the Full Review Commission. (KRS 338.071 (4)). If the case is not resolved at the administrative level, an aggrieved party may file an appeal in Franklin Circuit Court. (KRS 338.091 (1)). Series may contain: Occupational safety and health citations and notification of penalty, the notice of contest, complaint, answer, pleadings and commission orders; interlocutory orders; settlement agreement or a hearing transcript, exhibits, a recommended order, commission decision. If an aggrieved party files an appeal the file may contain: briefs, decision; and all legal documentation and proceedings.

Kentucky. Education and Workforce Development Cabinet
The Department of Education significantly changed due to the Kentucky Education Reform Act of 1990 (KERA). All positions in the Department of Education were abolished and the new commissioner of Education reorganized the Department with new positions in 1991. The Workforce Development Cabinet was also created in response to KERA. The State Board of Adult Vocational Education and Vocational Rehabilitation; Office of Vocational Rehabilitation; and Adult Basic Education programs were transferred to the new cabinet. The Department was reorganized again in 1998 and again in 2010. The Kentucky Department of Education provides resources and guidance to Kentucky's public schools and districts as they implement the state's K-12 education requirements. The department also serves as the state liaison for federal education requirements and funding opportunities. Current organizational structure is as follows: Office of the Commissioner; Office of Guiding Support Services and General Counsel; Office of Administration and Support; Office of Knowledge, Information and Data Services; Office of Next-Generation Schools and Districts; Office of Assessment and Accountability; and Office of Next-Generation Learners.
